1. Who you are contracting with

These Terms are a binding agreement between you and Haienaplan ("we", "us", "our"), the provider of the haienaplan service ("Service"). By creating an account or continuing to use the Service you agree to these Terms.

2. The Service

haienaplan is a travel planning application that lets you build itineraries, budgets, packing lists, outfit boards, vision boards, journals, and related trip content.

3. Your account

You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. You must be of legal age in your jurisdiction, or have authority to bind your organisation, to use the Service.

4. Acceptable use

You agree not to misuse the Service. In particular you must not:

• use the Service for any unlawful, fraudulent, or abusive purpose;
• upload content that infringes intellectual property or privacy rights;
• send spam or malware, or attempt to probe, scan, or breach security;
• scrape, reverse engineer, or resell the Service.

5. Intellectual property

Haienaplan retains all rights, title, and interest in the Service, including software, branding, and documentation. We grant you a limited, non-exclusive, non-transferable licence to use the Service within your chosen plan. You retain ownership of the trip content you upload; you grant us a limited licence to host and process it solely to provide the Service.

6. Payments, subscriptions, and billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payments, billing frequency, taxes, cancellations, and refunds are governed by the Paddle Checkout Buyer Terms and our Refund Policy.

7. Service availability

We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. Where possible, we will give you an opportunity to export your data before deletion.

9. Liability

To the fullest extent permitted by law, our aggregate liability under these Terms is capped at the fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law.

10. Governing law

These Terms are governed by the laws of the jurisdiction where Haienaplan is established, without regard to conflict of laws principles.

11. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.
